OREANDA-NEWS. September 23, 2010. The Ulyanovsk Office of the Federal Antimonopoly Service (OFAS Russia) received a ruling of the Federal Arbitration Court of the Povolzhye District that upheld the decision and determination issued by the antimonopoly body regarding “MegaTelecom” Ltd., reported the press-centre of FAS Russia.

On 8th October 2009, Ulyanovsk OFAS Russia initiated a case against “MegaTelecom” Ltd. based on a petition of “Vicont” Ltd. “MegaTelecom” Ltd. attempted to fix the contract price for technological connection of energy-receiving devices of “Vicont” Ltd. to telecommunications networks of “MegaTelecom” Ltd. by signing the contract and appendix to it.

Ulyanovsk OFAS Russia found that “MegaTelecom” Ltd. violated Clause 10 Part 1 Article 10 of the Federal Law “On Protection of Competition”.

“MegaTelecom” Ltd. violated the pricing procedures established by normative legal acts (applying for “Vicont” Ltd. the fee for technological connection to telecommunications networks, which was not approved). The Commission of Ulyanovsk OFAS Russia issued a determination to “MegaTelecom” Ltd.to stop antimonopoly violation.

“MegaTelecom” Ltd. filed a lawsuit to the Ulyanovsk Regional Arbitration Court, which pronounced legitimacy of the decision and determination issued by Ulyanovsk OFAS Russia. The Federal Arbitration Court of the Povolzhye District drew a line in the case, revoking the ruling of the Appeal Court and upholding the decision and determination of OFAS Russia.

The Head of Ulyanovsk OFAS Russia Gennady Spirichagov said: “Such rulings are very important for our Office as well as for our region in general. Network facilities must not be used to fix monopolistic prices. Now Ulyanovsk OFAS Russia will enforce its determination upon “MegaTelecom” Ltd.”
