OREANDA-NEWS. September 30, 2010. CenterTelecom OJSC reports that its claim related to cancellation of decision by Smolensk Directorate of the Federal Anti-Monopoly Service has been considered by the Smolensk Region Arbitration Court.

In accordance with the decision #95 dated 20 May, 2010 CenterTelecom was included in the register of legal entities with over 35% market share based on the following two codes of All-Russian Classification of Products:

·         code 64.20.16.112 (provision of connection to data transmission network excluding connection for voice transmission)

·         code 64.20.18.130 (provision of access to information in global and regional telecommunications networks including Internet)

In compliance with the decision by the Federal Anti-Monopoly Service CenterTelecom's market share in Smolensk region has been estimated at over 65%. Federal Anti-Monopoly Service's analysis of the Internet access market has been held in the course of consideration of the case related to breach of anti-monopoly legislation by CenterTelecom.

The Smolensk Region Arbitration Court has considered CenterTelecom's claim and the parties' arguments and declared invalid the decision by Smolensk Directorate of the Federal Anti-Monopoly Service "On amendment of the Register of Legal Entities with Over 35% Share or with Dominant Position in the Market" with regard to inclusion of CenterTelecom with over 65% share in the appropriate register based on codes 64.20.16.112 and 64.20.18.130 of All-Russian Classification of Products.
