OREANDA-NEWS. November 25, 2010. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Ministry of Industry and Trade of the Russian Federation, reported the press-centre of FAS Russia.

FAS discovered the signs of violating Part Article 15 of the Federal Law “On Protection of Competition”. Along with the state-owned facilities, the Ministry included private facilities in the List of industrial facilities within the jurisdiction and scope of activities of Ministry of Industry and Trade, approved by No.62 Order of the Ministry of Industry and Trade of 28th January 2010.

Under Article 8 of the Law “On Departmental Security Service”, departmental security service protects secure state-owned facilities that are within the jurisdiction of the relevant federal executive bodies. Protection of private secure facilities within the jurisdiction of federal executive bodies is exercised in accordance with the concluded contracts.

The List of secure facilities is determined by federal executive bodies and organizations that are authorized to form departmental security service and is approved according to the procedures established by the Government of the Russian Federation.

Under Article 8 of the Law “On Departmental Security Service”, departmental security service protects secure facilities that are in state property.

The Ministry of Industry and Trade of the Russian Federation approved the List that includes not only state-owned facilities but also private facilities. It has the signs of restricting competition as private security firms are deprived of a possibility to render protection services of private facilities included in the List.

The case hearing is scheduled on 15th December 2010.

FAS Russia already investigated a similar case against the Ministry of Energy of the Russian Federation and found that the Ministry of Energy violated the antimonopoly law. Legitimacy of the FAS Russia’s decision and determination were confirmed by court of law.
