OREANDA-NEWS. December 14, 2010. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Federal Agency for State Property Management (Rosimuschestvo) upon the signs of violating Clause 2 Part 1 Article 17 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

The case was initiated upon a petition from a physical person received by FAS Russia.

FAS Russia suspects that Rosimuschestvo violated the Federal Law “On Protection of Competition” as Rosimuschestvo unlawfully restricted access of the petitioner to competitive bidding for sale of 222,700 ordinary shares of “Khladokombinat” OJSC, which are in federal property and constitute 51% of the authorized capital of “Khladokombinat” OJSC.

The case will be considered on 20th December 2010.

Clause 2 Part 1 Article 17 of No.135-FZ Federal Law “On Protection of Competition” of 26th July 2006 prohibits actions in course of competitive bidding, that lead or can lead to preventing, restricting or eliminating competition, particularly, creating preferential conditions for a bidder (several bidders), including access to information, unless provided otherwise by the Federal Law.
