OREANDA-NEWS. December 29, 2010. After getting acquainted with the joint stock company “Latvijas kugnieciba” (Latvian Shipping Company – LSC) shareholder’s JSC “Ventspils nafta” (VN) representative’s Mr. Mark Morell Ware public statements in the Latvian mass media, the LSC management Board members have addressed the Riga City Latgale Suburb Court with an appeal to commence criminal proceeding in a case of private prosecution. LK Management Board members appeal to the court to call M. Ware to justice pursuant to Section 157, Part 2 of The Criminal Law about intentional defamation.

In their application to the court the LK Management Board members point out that interviews with M. Ware that were published in several mass media last week contain a line of false statements that insult LK Management Board members, discredit and cause serious harm to them. The untrue and disreputable fictions of M. Ware arouse suspicions to a wide range of interested persons that the LK Management Board members have committed crime.

Distribution of fictions, knowing them to be untrue and defamatory of another person, in newspapers is qualified pursuant to Section 157, Part 2 of The Criminal Law. The said provision of the Criminal Law prescribes liability for knowingly committed intentional distribution of fictions, knowing them to be untrue and defamatory of another person in the mass media.
