OREANDA-NEWS. February 22, 2011. Deputy Head of the Federal Antimonopoly Service (FAS Russia) Andrey Tsyganov addressed the OECD Global Competition Forum at the Round Table on “Control of Transactions on Transnational Markets - Challenges for Developing and Emerging Economies”, reported the press-centre of FAS Russia.

Andrey Tsyganov stated that FAS Russia has a solid experience of multilateral and bilateral agreements with foreing competition agencies and integration associations, many of which include provisions on information exchange with due account for confidentiality issues, particular, in conducting specific investigations or considering transactions by competition authorities of the states that are signatures to such agreements.

The mechanism and procedures for cooperation between the parties toward enforcement of competition law are most clearly spelt out on the Agreements of Cooperation in the field of competition policy between FAS Russia and the Competition Commission of the United Mexican States and between FAS Russia and the Hungarian Competition Authority. Along with the competition authorities of these countries FAS Russia is actively involved in exchanging information within the framework of ICAP (the Interstate Council for Antimonopoly Policy) and the Headquarters for Joint Investigations.

Apart from exchanging information on the official level, FAS Russia held consultations with the Directorate General on Competition of the European Commission, for example, on the essence of antimonopoly control of the Oracle Corporation acquiring Sun Microsystems, - applying the mechanism of “waivers”, particularly, receiving official non-confidentiality letters from these companies.

“Even in the absence of an official agreement framework providing for exchange of confidential information, the level of relations with our partners enables effective cooperation”, said Andrey Tsyganov.
