OREANDA-NEWS. March 21, 2011. Moscow Arbitration Court dismissed the claim of “Bashinformsvyaz” OJSC on invalidating the determination issued by FAS Russia, reported the press-centre of FAS Russia.

On 25th March 2010, FAS Russia found that “Bashinformsvyaz” OJSC violated Clauses 5 and 8 Part 1 Article 10 of the Federal Law “On Protection of Competition” (abusing market dominance).

FAS Russia received a complaint from “STsS Sovintel” Ltd. that “Bashinformsvyaz” OJSC was forcing its clients to accept the traffic transmission procedures that would be of maximum advantage for the company (through zonal transit nodes) and also unreasonably evaded contracts for connecting the network of zonal communications of “STsS Sovintel” Ltd. to the local and zonal telephone communications network of “Bashinformsvyaz” OJSC.

Also “Bashinformsvyaz” OJSC set discriminatory conditions in the Conditions for Connecting Telecommunication Networks and Traffic Transmission in the part of traffic transmission restrictions for the connected provider using strictly fixed number pool resources in comparison with “Bashinformsvyaz” OJSC.

“MTS” OJSC also complained to FAS Russia about “Bashinformsvyaz” OJSC. The case is pending at Moscow Arbitration Court.

“The FAS Russia’s decision is aimed at creating conditions for development of competition on the market of intra-zonal telephone communications, the markets of connection services and traffic transmission at the zonal level in the Republic of Bashkortostan”, commended Dmitry Routenberg, the Head of the FAS Russia’s Department for Control over Transport and Communications.
