OREANDA-NEWS. April 27, 2011. Popelikhino district court at the Altai Territory awarded a sentence to citizens M. G. Kutsenko and V. A. Fomina who were convicted for crime specified in Article 30, Part 3 and Article 159, Part 2 of the Criminal Code of the Russian Federation, which is attempt of fraud, i.e. theft of property by means of false pretence by a group of persons with previous concert.

The court established that in January 2009, the dweller of Posptlikha village M. G. Kutsenko applied to Ingosstrakh OJSIC for an insurance event, a car accident committed by A. V. Fomin, the owner of GAZ 310290 motor car insured by Ingosstrakh OJSIC under compulsory motor civil liability insurance agreement. But operational information evidenced that the accident was falsified and all the documents were fabricated by M. G. Kutsenko who had legal education. The application for payment of insurance indemnity was rejected under this case.

M. G. Kutsenko applied to the court and personally took part in the court proceedings as a representative of the affected party. He won the proceedings. According to the court resolution, M. G. Kutsenko was paid RUB 120,000.

Despite this fact, employees of Ingosstrakh OJSIC Information Analysis and Protection continued to work under this case. The investigation revealed that Toyota Camry car that was covered by the indemnity was owned by Kutsenko’s acquaintance. She was involved in a car accident in Novosibirsk and sold the damaged car to Kutsenko afterwards, who fabricated the insurance event documents aided by his accomplice Fomin.

Ingosstrakh OJSIC employees found the second participant of the Novosibirsk accident. They got the true evidence about the cause for Toyota Camry damage from him and E. G. Moroshenko, who was the accident witness. The collected materials were submitted to militia and the criminal case was brought to action against Kutsenko and Fomin. The court convicted them both and sentenced to 240 and 200 hours of compulsory labour respectively.

The criminal judicial board in the Altay Territory reviewed Kutsenko’s and Fomin’s writs of appeal against Pospelikhino district court in the Altay Territory. The verdict was left unchanged and came into force. This is the first judgment of guilt for insurance fraudsters in the Altay Territory.

Currently,  Ingosstrakh OJSIC prepares a civil claim to return the amount of 120,000 paid earlier under Kutsenko’s order of enforcement.
