OREANDA-NEWS. May 12, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against “Postavki Dlya Silovykh Struktur” Ltd., “KN Avto Modern” Ltd. and “NPP Zelos” Ltd. upon the signs of violating Clauses 2, 4 and 8 Part 1 Article 11 of the Federal Law “On Protection of Competition” (prohibiting price increase at competitive bidding, economically unjustified refusal to conclude contracts with buyers and prevention of market entry), reported the press-centre of FAS Russia.

The case was initiated upon a petition of “InterSnab” Ltd.

FAS Russia established that the Department for Military Technical Procurement, Special Communications, the Federal Guard Service of the Russian Federation, organised an open auction in the electronic form for procurement of inverted multiplexer.

“Two companies took part in the auction: “Postavki Dlya Silovykh Struktur” Ltd. and “InterSnab” Ltd. As FAS Russia believes, when aplying for the auction both companies had preliminary arrangements about equipment supply with “NPP Zelos” Ltd. “InterSnab” Ltd. won the auction. “Postavki Dlya Silovykh Struktur” Ltd. did not bid at the auction and took the second position”, explains the Head of the FAS Russia’s Cartel Department Alexander Kinev. “Later “InterSnab” Ltd. was unable to execute the government contract because “NPP Zelos” Ltd. refused to supply equipment, that was the subject of the government contract, to the winner on the grounds that equipment was supplied through “KN Avto Modern” Ltd. At the same time the price of “KN Avto Modern” Ltd. was twice as high as the price quote by the manufacturer. As a result the right to conclude the government contract was transferred to “Postavki Dlya Silovykh Struktur” Ltd.

“Manufacturer’s refusal to sell equipment to “InterSnab” Ltd. in order to execute the contract can indicate collusion between the manufacturer, “Postavki Dlya Silovykh Struktur” Ltd. and “KN Avto Modern” Ltd.”, points out Alexander Kinev.

The case is scheduled for 12th May 2011.
