OREANDA-NEWS. May 31, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Federal Service for Veterinary and Phyto-Sanitary Control (Rosselkhoznadzor) upon the signs of violating Part 1 Article 15 of the Federal Law “On Protection of Competition” – unreasonable prevention of activities of economic entities, reported the press-centre of FAS Russia.

The case was initiated upon complaints from a foreign company “VIC Animal Health” and “VIC Animal Health” Ltd. that Rosselkhoznadzor had refused to accept documents to confirm the state registration of veterinary registration due to absence of an approved form of a document, containing the findings of monitoring of medicine safety.

The Federal Law “On Circulation of Medications” provides for continuation of civil circulation of medicines in the Russian Federation in course of confirmation of state registration.

Due to the refusal of Rosselkhoznadzor to accept the documents, the procedures for confirming state registration of veterinary medicines has not been started. As the period for temporary registration of medicines is over, at the moment civil circulation of medicines, produced by the petitioners, is not possible.

Thus, actions of Rosselkhoznadzor prevented activities of petitioners related to circulation of veterinary medicines and reduced the number of medicines circulating on the market.

The case will be considered on 6th July 2011.
