OREANDA-NEWS. June 06, 2011. The Federal Antimonopoly Service (FAS Russia) fined “Caustic” OJSC 191,500,950 Rubles, “Khimpek” AK” CJSC” – 1,970,929 Rubles and “Logosib” Ltd. – 4,889,300 Rubles under Article 14.32 of the Code of the Russian Federation on Administrative Violations. FAS continues administrative proceedings against “Orion” Ltd., “Biakr” Ltd. and “Promkhim” Ltd., reported the press-centre of FAS Russia.

On 9th February 2011, FAS Russia found “Caustic” OJSC", “Orion” Ltd., “Biakr” Ltd., “Promkhim” Ltd, “Khimpek” AK” CJSC and “Logosib” Ltd. violated Clauses 1 and 2 Part 1.2 Article 11 of the Federal Law “On Protection of Competition”. FAS did not issue a determination due to voluntary elimination of the violation.

The producer of caustic soda - “Caustic” OJSC - and its buyers violated the law because they concluded dealer agreements containing requirements that could have resulted in fixing resale prices for the goods. The agreements prohibited dealers to conclude similar dealer agreements with other producers or buy similar products from them.

Part 1.2 Article 11 of the Federal Law “On Protection of Competition” prohibits “vertical” agreements between economic entities.
