OREANDA-NEWS. July 12, 2011. The Arbitration Court of the Republic of Bashkortostan upheld the decision and determination of the Office of the Federal Antimonopoly Service in the Republic of Bashkortostan (Bashkortostan OFAS Russia) on the case of unlawful concerted actions of wholesale suppliers of peeled buckwheat, reported the press-centre of FAS Russia.

On 19th November 2010, Bashkortostan OFAS Russia found that “Pangeya” Ltd., “Drozdoff” Ltd., “Satyevo” Ltd. and “Sakharok” Ltd. violated Clause 1 Part 1 Article 11 of the Federal Law “On Protection of Competition”.

The companies were engaged in concerted actions that led to fixing and maintaining unreasonably high prices for buckwheat in July – September 2010 in the Republic of Bashkortostan.

“The Court drew a line: taking an advantage of non-elastic demand for buckwheat, the wholesale suppliers unlawfully fixed high prices through anticompetitive concerted actions”, commented the Head of Bashkortostan OFAS Russia Zulfira Akbasheva.

Clause 1 Part 1 Article 11 of the Federal Law “On Protection of Competition” prohibits agreements or concerted actions of economic entities on the market, if such agreements or concerted actions lead or can lead to fixing or maintaining prices (tariffs), discounts, mar-ups, surcharges.
