OREANDA-NEWS. July 15, 2011. The Arbitration Court of the Republic of Dagestan heard the case and pronounced legitimacy of the decision made by the Office of the Federal Antimonopoly Service in the Republic of Dagestan (Dagestan OFAS Russia) regarding “North Caucasus MRSK”OJSC and “Dagestan Energy Supplier” (“DESK”) OJSC, reported the press-centre of FAS Russia.

Earlier the Commission of Dagestan OFAS Russia found that “North Caucasus MRSK” OJSC and “DESK” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition”.

Upon a request of “DESK” OJSC, “North Caucasus MRSK” OJSC restricted electric power supply to “Kaspenergosbyt” Ltd. (Kaspiisk) due to the company’s debt for consumed electric power. Such restrictions of electric power supply also resulted in switching off bona fide customers (subscribers of Kaspenergosbyt” Ltd.) and had socially dangerous consequences.

“North Caucasus MRSK” OJSC and “DESK” OJSC filed lawsuit to Arbitration Court of the Republic of Dagestan attempting to invalidate the decision of Dagestan OFAS Russia. The Court dismissed the claims and pronounced legitimacy of the OFAS decision.

“The Court confirmed legitimacy of the decisions made by Dagestan OFAS Russia regarding persons that abuse their market dominance. This is very important, particularly in order to prevent further antimonopoly violations”, said the Head of Dagestan OFAS Russia, Kurban Kubasaev.
