OREANDA-NEWS. December 09, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Federal Service for Supervision over Consumer Rights and Human Well-Being (Rospotrebnadzor) upon the signs of violating Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

Rospotrebnadzor failed to amend its Order “On Sanitary-Epidemiological Expert Examinations, Surveys, Research, Testings, and Toxicological, Hygienic and Other Types of Assessments” of 19th July 2011. The Order does not specify that according to a Decree of the Government of the Russian Federation, sanitary-epidemiological expert examination for the purposes of licensing certain types of activities exercised by subordinate organisations of Rospotrebnadzor, must be carried out free-of-charge (1).

As stated by the Decree, the federal ministries must approve the techniques for determining the size and limits for the fee for the necessary and mandatory services to be provided by federal executive bodies and are provided by federal state organisations or enterprises controlled by the above authorities, as well as amend their normative legal acts in accordance with the Decree.

The Government Decree also specifies that sanitary-epidemiological expert examinations for the purposes of licensing certain types of activities must be carried out free-of-charge.

The case is scheduled on 16th December 2011.
