OREANDA-NEWS.  December 16, 2011. The Federal Arbitration Court of the West-Siberian District (Omsk region) pronounced legitimacy of the decision made by the Office of the Federal Antimonopoly Service in the Omsk region (Omsk OFAS Russia) regarding wholesale suppliers of buckwheat, reported the press-centre of FAS Russia.

In September 2010, Omsk OFAS Russia found that that “Shkurenko” Trading House” Ltd., “Melnitsa” Trading House” Ltd., “Omskoye” OJSC, “SibSol” Trading House” Ltd., “Inkos” Trading House” Ltd. and five individual entrepreneurs violated Part 1 Article 11 of the Federal Law “On Protection of Competition”.

The violation: concerted actions on the market of wholesale sales of buckwheat in the Omsk region by fixing unreasonably high prices in July – August 2010.

“Shkurenko” Trading House” Ltd., “Melnitsa” Trading House” Ltd., “Omskoye” OJSC and “SibSol” Trading House” Ltd. filed a lawsuit challenging the decision of the antimonopoly body.

However, the Courts of three instances pronounced legitimacy of the decision made by Omsk OFAS Russia.

“The Cassation Court accepted the arguments of the antimonopoly body that in the analysed period there had been no objective reasons for synchronous increase of ex-works buckwheat prices for a value exceeding the growth of purchasing prices”, explained the Head of Omsk OFAS Russia, Sergey Sumenkov.
