OREANDA-NEWS. January 17, 2012. The Federal Antimonopoly Service (FAS Russia) initiated a case upon the signs of “Dneprovagonmash” OJSC (of Ukraine) and “Evraziisky Truboprovodny Consortium” Ltd. (the Russian Federation) concluding an anticompetitive agreement. Such actions are contrary to Part 2 Article 11 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

The case was initiated a petition received by FAS from “Chelyabinsk Tube-Rolling Plant” OJSC (“Chelpipe” OJSC), according to which “Dneprovagonmash” OJSC was evading a contract for supplying flat cars for flat steel, 13-4107 model, designed to transport flat products, width – up to 4450 mm.

FAS suspects that actions of “Dneprovagonmash” OJSC and “Evraziisky Truboprovodny Consortium” Ltd. have some signs of violating the antimonopoly law – concluding and executing an exclusive contract for manufacturing and supplying flat cars, model 13-4107, to “Evraziisky Truboprovodny Consortium” Ltd.

Along with general contact conditions “Dneprovagonmash” OJSC undertook obligations to manufacture and supply flat cars for flat products and their modifications exclusively to “Evraziisky Truboprovodny Consortium” Ltd., and supplies to other buyers can only be exercised only upon agreement with “Evraziisky Truboprovodny Consortium” Ltd.

The case is scheduled for 27th February 2012.
