OREANDA-NEWS. January 25, 2012. The Federal Antimonopoly Service (FAS Russia) revealed some signs of violating the antimonopoly law in actions of companies included in the group of persons of “GAZ” OJSC and their dealers, reported the press-centre of FAS Russia.

Based upon the results of examining a petition of “Avtodiesel-Service” PSF” OJSC, FAS Russia initiated a case against “Avtodiesel” OJSC, “YaZDA” OJSC, “Silovie Agregaty – Gruppa GAZ” Ltd. and companies of предприятий дилерской сети upon signs of violating Clause 5 Part 1 Article 10 and Part 2 Article 11 of the Federal Law “On Protection of Competition”.

To sell the products of “Avtodiesel” OJSC (power units/ diesel engines) and “YaZDA” OJSC (fuel equipment), “Silovie Agregaty – Gruppa GAZ” Ltd. concludes supply contracts with companies from a dealer network. In the FAS opinion, such contracts restrict sales organizations in their free choice of the area of reselling supplied products, which can constitute sings of violating Part 2 Article 11 of the Federal Law “On Protection of Competition”.

Earlier “Avtodiesel-Service” PSF” OJSC repeatedly enquired “Silovie Agregaty – Gruppa GAZ” Ltd. regarding changing terms and conditions of the dealer agreement, however enquired “Silovie Agregaty – Gruppa GAZ” Ltd. not only did not change the wording of the contract but did not prolong it for the following period.

“Avtodiesel-Service” PSF” OJSC sent an offer to“Avtodiesel” OJSC, “YaZDA” OJSC and “Silovie Agregaty – Gruppa GAZ” Ltd. to conclude a new supply contract; however, these economic entities did not consider it and evaded the contract, which has sings of violating Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”.

These circumstances constituted the basis for “Avtodiesel-Service” PSF” OJSC petitioning to the antimonopoly authority.

The case is scheduled for 20 February 2012.
