OREANDA-NEWS. January 30, 2012. The Federal Antimonopoly Service of Russia has received a notification that the “Federal Grid Company of the Unified Energy System of Russia” OJSC paid a multi-million fine for violating the antimonopoly law on the market of electric power. The total sum of the fine paid by the company is over 130 million Rubles, reported the press-centre of FAS Russia.

In August 2010, FAS Russia found that the “Federal Grid Company” violated Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition” in the part of imposing disadvantageous contact terms and conditions upon “Tyumenenergo” OJSC in the interests of “LUKOIL-ENERGOSETI” OJSC regarding “Novie Pokachi” and “Kechimovskaya” electric power substations.

The company tried to impose disadvantageous conditions upon “Tyumenenergo” OJSC in a contract for technological connection that are not directly provided for by the normative legal acts.

For violating the antimonopoly law, FAS fined the “Federal Grid Company” under Article 14.31 of the Code on Administrative Violations.

The “Federal Grid Company” disagreed with the decisions and determinations of the Antimonopoly Service and challenged them at Courts.

The Federal Arbitration Court of the Moscow District, that examined these cases as a Cassation Court, supported FAS position.

The Supreme Arbitration Court of the Russian Federation dismissed the claim to transfer the case to the Presidium of the Supreme Arbitration Court of the Russian Federation for the purposes of a supervisory review.

Thus, the “Federal Grid Company” had to admit the fact of committing the violation and pay over 130 million Rubles to the federal budget.
