OREANDA-NEWS. February 06, 2012. FAS found that “Gazprom” OJSC that has dominant position on the federal market for gas transportation violated Part 1 Article 10 of the Federal Law “On Protection of Competition”б reported the press-centre of FAS Russia.

“Gazprom” OJSC unreasonably refused “Real-Gaz” Ltd. to have access to the gas-transportation system of “Gazprom” OJSC, by refusing to grant a petition for access and refusing to conclude a contract for gas transportation according to the procedures and the form established by the Regulations for providing access of independent organizations to the gas-transportation system of “Gazprom” OJSC, approved by No.858 Decree of the Government of the Russian Federation of 14th July 1997. It infringed the interests of “Real-Gaz” Ltd.

As the grounds for refusal, “Gazprom” OJSC specified “full provision of customer’s needs in natural gas from resources of other suppliers” as well as absence of possibility “to provide guaranteed gas supply to Mikhilovka-2 station”. However, the Provisions does not provide for such grounds for refusal to conclude a gas transportation contract.
