OREANDA-NEWS. March 07, 2012. “Electric Company” Ltd. (“ElCo”) executed a warning of Karachaevo-Cherkessia OFAS to stop violating the antimonopoly law (imposing disadvantageous contract conditions), reported the press-centre of FAS Russia.

Earlier the antimonopoly body considered a complaint from a resident of Karachaevsk that “ElCo” Ltd. installed a new electric power meter on the stairway where her flat is located without notifying the petitioner and handing her over a commissioning act. She was not requested to pay for the consumed electric power without taking into account the readings of an individual electric power meter installed inside the flat and commissioned according to the procedures established by law. The requested payment for consumed electric power considerably increases the costs of actually consumed electric power for both the reading of the newly installed meter on the stairway and the reading of the in-flat meter.

Karachaevo-Cherkessia OFAS found that “ElCo” Ltd. violated Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition” and issued a determination to stop the violation.

“Since the end of 2011, amendments have been introduced to the law on competition protection, according to which an antimonopoly body must issue warnings to stop violating the antimonopoly law. Only in January 2012 Karachaevo-Cherkessia OFAS issued for such determinations. The case of “ElCo” Ltd. shows that the company, which has dominant position, can without prejudice for yourself eliminate violations of the antimonopoly law and satisfy the interests of the petitioner who approached the Antimonopoly Service. “ElCo” Ltd. took the warning reasonably and made all calculations for electric power consumption by the petitioner as the antimonopoly body required”, said the First Deputy of Karachaevo-Cherkessia OFAS, Kair Babaev.
