OREANDA-NEWS. March 07, 2012. The Federal Arbitration Court of the North-Caucasus District upheld the decision of the Office of the Federal Antimonopoly Service in the Rostov Region (Rostov OFAS Russia) regarding “TZK-AVIA” CJSC and “Bashneft-Yyug” Ltd., reported the press-centre of FAS Russia.

In October 2009 – July 2010, “TZK-AVIA” CJSC together with its aviation fuel supplier - “Bashneft-Yyug” Ltd. maintained unreasonably high level of purchasing prices for aviation kerosene. Concerted actions of “TZK-AVIA” CJSC and its supplier pushed up the price for aviation kerosene, which “TZK-AVIA” CJSC sold to air carriers in the airport in Rostov-on-Don.

Rostov OFAS Russia found that “TZK-AVIA” CJSC violated Part 1 Article 11 of the Federal Law “On Protection of Competition” (concerted actions aimed at fixing and maintaining prices). The Courts of the three instances confirmed legitimacy of this decision.

“For participating in a collusion, OFAS imposed administrative fines upon “TZK-AVIA” CJSC и “Bashneft-Yyug” Ltd. - 3 million and 808,000 accordingly. Last year “Bashneft-Yyug” Ltd. paid the fine in full, while the refueling operator challenged the fine at Court. At the end of January 2012 Rostov Regional Arbitration Court pronounced legitimacy of the fine imposed upon “TZK-AVIA” CJSC”, commented the Head of Rostov OFAS Russia, Vadim Korneev.
