OREANDA-NEWS. March 13, 2012. The Federal Antimonopoly Service (FAS Russia) fined “State-Run Corporation for Air Traffic Management” Federal State Unitary Enterprise 100,000 Rubles for creating discriminatory conditions for its counteragents, reported the press-centre of FAS Russia.

The antimonopoly body imposed an administrative fine according to Article 14.31 of the Code of the Russian Federation on Administrative Violations.

Earlier FAS found that the State-Run Corporation violated Clauses 5 and 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”, and “Letnie Proverki i Sistemy” CJSC (a member of the group of persons of “State-Run Corporation for Air Traffic Management”) - violated Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”.

The FAS Commission established that “Letnie Proverki i Sistemy” CJSC, as a member of the group of persons of “State-Run Corporation for Air Traffic Management” unreasonably evaded concluding a sub-contract with “Skytest” Airlines” CJSC for completing the works for flight reviews of ground facilities for radio-technical communications and navigational equipment.

As a result of “State-Run Corporation for Air Traffic Management” abusing its dominant position on the market of aviation works for flight reviews of ground facilities for radio-technical support, aeronautical telecommunications and systems of lighting navigational aids in civil aerodromes in the Russian Federation, “Skytest” Airlines” CJSC was pushed out from the market and for a long period of time was unable to exercise economic activities.

The Courts of two instances confirmed the rightness and reasonableness of the decision of the antimonopoly body.
