OREANDA-NEWS. April 26, 2012. Ulyanovsk Regional Arbitration Court pronounced legitimacy of the decision and determination of the Office of the Federal Antimonopoly Service in the Ulyanovsk Region (Ulyanovsk OFAS Russia) regarding Russian Post” Federal State Unitary Enterprise, reported the press-centre of FAS Russia.   

The case was initiated upon a petition of “Ural-Press Povolzhie” Ltd. that “Russian Post” Federal State Unitary Enterprise in the persons of the Office of the Federal Postal Service in the Ulyanovsk Region refused to conclude a contract for distributing newspaper packs.

The company had a contract with “Kommersant-Volga” CJSC. The contract subject: actions of “Ural-Press Povolzhie” Ltd. towards registering and executing subscription agreements for the first and second halves of 2010 for periodical print media. The publications are owned by “Kommersant-Volga” CJSC. The right of ownership for the publications is transferred from “Kommersant-Volga” CJSC to third persons when the publications are transferred to the third persons. Therefore, to honour its obligations under the contract with “Kommersant-Volga” CJSC in the part of executing subscription agreements - transferring the publications to third parties - “Ural-Press Povolzhie” Ltd. must conclude a contract for distributing newspaper packs with a postal establishment - the Office of the Federal Postal Service in the Ulyanovsk Region – a branch of “Russian Post” Federal State Unitary Enterprise.

“Russian Post” Federal State Unitary Enterprise concluded similar contracts with nine economic entities.

In February 2012, Ulyanovsk OFAS Russia found that “Russian Post” Federal State Unitary Enterprise violated Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition” and issued a determination to stop the violation.

“The Court ruling is an important step towards developing competition on the market for subscribing for print media”, said Deputy Head of Ulyanovsk OFAS Russia, Konstantin Popov.
