OREANDA-NEWS.May 05, 2012. The Federal Arbitration Court of Dalnevostochny Federal District confirmed legitimacy of a decision of Primorie OFAS Russia to impose an administrative fine for abusing market dominance, reported the press-centre of FAS Russia.

In 2009 Primorie OFAS Russia established that “Vladivostok International Airport” OJSC violated Clause 1 Part 1 Article 10 of the Federal Law “On Protection of Competition”, fixing monopolistically high price for supplying aviation fuel and lubrication materials.

OFAS issued a mandatory determination to the company to stop violating the antimonopoly law and imposed an administrative fine – 3,212,391 Rubles.

After lengthy judicial proceedings the Arbitration Courts of First and Second Instances pronounced legitimacy of the determination issued by the antimonopoly body. The fine was reduced to 1,070,797 Rubles.

“Vladivostok International Airport” OJSC disagreed with the Court rulings and lodged a cassation appeal.

On 18th April 2012, the Court dismissed the cassation appeal and obligated the airport to pay the fine.

“Finally, the Court drew a line under judicial proceedings that lasted three years. During this period the antimonopoly body sought to defend its decision to hold “Vladivostok International Airport” OJSC administratively liable for the established fact of abusing market dominance. Now, when the Cassation Court passed a ruling, we can firmly say that we succeeded”, commented Deputy Head of Primorie OFAS Russia, Viktor Tryakin.
