OREANDA-NEWS. June 13, 2012. A justice’s court issued a determination to impose an administrative fine upon General Director of “Caustic” OJSC (of Sterlitamak), Mr. An Yen Dok, reported the press-centre of FAS Russia.     

On 10th May 2012, the Federal Antimonopoly Service (FAS Russia) initiated a case on a cartel agreement on the market of polyvinylchloride.

Based on a FAS order, the Antimonopoly Service carried out an unscheduled inspection to verify whether “Caustic” OJSC complied with the antimonopoly law. Mr. An Yen Dok read the order to carry out the inspection; nevertheless, in course of premises inspection “Caustic” OJSC refused to present the requested documents to the Head of FAS inspection.

Failure to obey a lawful demand of the Head of FAS inspection is classified as an administrative violation under Part 1 Article 19.4 of the Code on Administrative Violation and is punishable by a fine up to 4,000 Rubles.

Having examined the case, the judge concluded that oral requests by the Head of the FAS inspection to submit documents in course of inspecting premises conform with the norms the Federal Law “On Protection of Competition” and Regulations of the Federal Antimonopoly Service, while actions of the General Director of “Caustic” OJSC Mr. An Yen Dok are unlawful.
