OREANDA-NEWS. July 30, 2012. “RN-Trading” Ltd. paid over 380 million Rubles to the federal budget for violating the antimonopoly law under the “third wave” of case against oil companies, reported the press-centre of FAS Russia. 

On 24th July 2012, the Federal Antimonopoly Service (FAS Russia) was notified that the company had paid the turnover fine. Investigating the “third wave” of antimonopoly cases against oil companies, FAS established that “RN-Trading” Ltd. is a subsidiary of “Rosneft” Oil Company” OJSC and is a member of the same group of persons with “Rosneft” OJSC.

Based on the information submitted by “Rosneft” OJSC in course of the case investigation, oil products were produced and sold by directly “Rosneft” OJSC as well as “RN-Trading” Ltd. at oil refineries, included in the group of persons of “Rosneft” OJSC.

According to the antimonopoly law, prohibitions of actions of economic entity or economic entities apply to actions of the whole group of persons.

Thus, the company and a member of its group of persons - “RN-Trading” Ltd. were held responsible for a sharp increase of wholesale prices for diesel fuel and aviation kerosene sold by the group of persons of “Rosneft” OJSC in Q4 2010.

In August 2011, FAS found that “Rosneft” OJSC and a member of its group of persons - “RN-Trading” Ltd. violated Clause 1 Part 1 Article 10 of the Federal Law “On Protection of Competition”. The group of persons abused its dominant position on the market of wholesale sales of diesel fuel and aviation kerosene by fixing and maintaining monopolistically high prices. At the end of last year the Antimonopoly Service imposed an administrative fine upon the group of persons of “Rosneft” OJSC - 1,756,146,528 Rubles under Article 14.31 of the Code of the Russian Federation on Antimonopoly Violation.

In February “Rosneft” Oil Company” OJSC paid the most part of the fine, having transferred over 1.3 billion Rubles to the federal budget of Russia.

On 24th July 2012, FAS was informed that “RN-Trading” Ltd., a member of the group of persons of the oil company, paid the remaining part of the turnover fine - over 380 million Rubles.

Under the “third wave” of cases, the antimonopoly authority fined four oil companies: “TNK-ВР (approximately 1.3 billion Rubles), “Gazprom Neft” (over 900 million Rubles), “Rosneft” (around 1.7 billion Rubles) and “Bashneft” " (778 million Rubles).

All companies paid turnover fine in full.
