OREANDA-NEWS. August 09, 2012. In view of some media publications about the Rules of non-discriminatory access to apatite concentrate devised by the Federal Antimonopoly Service (FAS Russia) and related judicial proceedings, FAS would like to state the following, reported the press-centre of FAS Russia:

The Rules for non-discriminatory access to apatite concentrate have not yet been approved by the Government of the Russian Federation and at the moment are recommendatory. The Rules determine and clarify the rules of the game for the participants of the relevant market, clearly define the position of the regulator as to which actions of companies can be recognized as violations of the law and which cannot be classified as such.

“The Rules for non-discriminatory access to apatite concentrate are a “safe harbour” for business. If companies follow them, FAS shall not have issues with their activities. It is good when the market knows in advance the position of the regulator and can build-up its policy in accordance with the law and the position of the controlling body”, explained the Head of FAS Igor Artemyev.
