OREANDA-NEWS. September 11, 2012. Sverdlovsk Regional Arbitration Court pronounced legitimacy of a fine imposed upon “Rostelecom” OJSC, reported the press-centre of FAS Russia.

On 29th July 2011, the Office of the Federal Antimonopoly Service in the Sverdlovsk Region (Sverdlovsk OFAS Russia) found “Rostelecom” OJSC violated Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition” (abusing dominance).

“Rostelecom” OJSC violated the law by imposing a disadvantageous contract upon a counteragent – “Veres” Ltd. that operates a data transmission network. The contract also included a condition irrelevant to the contract subject to grant a subscriber line for use and make monthly payments for using it. Earlier the line was already assigned to a subscriber under a local telephony contract and the subscriber was also charged according to the tariff.

Sverdlovsk OFAS Russia fined “Rostelecom” OJSC 7,505,307 Rubles.

“Rostelecom” OJSC disagreed with the decision of the Commission of Sverdlovsk OFAS Russia and lodged a lawsuit to invalidate the fine. The Court, however, confirmed legitimacy of the actions of Sverdlovsk OFAS Russia. The claim of “Rostelecom” OJSC was allowed only in the part of reducing the fine to 6,919,456.30 Rubles.
