OREANDA-NEWS. January 18, 2013. The first days of the functioning a new state registration system of rights to real estate and their burdening, which is integrated in Ukraine from 01.01.2013 years showed its efficiency and effectiveness. This was stated by First Deputy Chairman of the State Registration Service of Ukraine Inna Zavalna during a press briefing at the Government House.

She said that today 583 regional branches of the State Registration Service operate. Services for registration of real estate rights 6835 notaries also provide, who are connected to the State register of real rights.

Among the advantages of the new system Inna Zavalna named the reduction of number of instances and the list of documents and the creation of the Unified State Register of Rights to Real Estate.

As of today the state registration of rights and burdening on the real estate is carried out by the State Registration Service and notaries as special subjects of registration of real estate. Accordingly, all information on the proprietary rights and burdening recorded in the Unified State Register of property rights.

Issuance of title certificates to real property located on the land and on land is carried by the State Registration Service.

Difference of powers of the State Registration Service and notaries: if the rights to immovable property were registered before 1 January 2013 (in the Registry or on paper) and if a men want to sell real estate, he refers directly to the notary, who has to register a property right in the Register, perform a notarial act and register ownership of the property for a new owner in the Register. If the registration of rights to real estate has already been done the citizens and legal entities are exempt from state tax.

"As for the registration certificate, the decision of such registration and registration of newly constructed and reconstructed objects of immovable property, such registration is carried out by territorial bodies of the State Registration Service" - Inna Zavalna added.

In addition, among the advantages of the new system is a significant reduction of the cost of services. Today, for registration of the title certificate to real property and receiving statement fixed fee is paid, which is UAH 119 (for registration of rights and registration of certificate) and UAH 120 for completion of the extract.

Among positive aspects of the system is the reducing the number of documents. In particular, now you shouldn’t in each case to submit data sheet: "Only in certain changes (remodeling or re-planning), in this case, you must formalize technical certificate and if there are no changes it is not obligatory to submit technical certificate for real estate", the official noted, adding that the registration is under controlled by the State Registration Service and the Ministry of Justice.
