OREANDA-NEWS. February 18, 2013. The Federal Antimonopoly Service (FAS Russia) found that “Moscow United Electric Grid Company” OJSC (“MOESK” OJSC) violated the antimonopoly law, and issued a determination to the company to transfer over 230 million Rubles to the federal budget, reported the press-centre of FAS Russia.

Earlier FAS organized an unscheduled on-site enquiry regarding “MOESK” OJSC and exposed various violations with regard to concluding and executing contracts on technological connection of non-stationary retail facilities with the Councils, state agencies, and state managing companies of districts of Moscow administrative divisions (Clause 1 Article 10 of the Federal Law “On Protection of Competition”).

In June 2011 – November 2012, District Councils concluded contracts with “MOESK” for technological connection of non-stationary retail facilities to electric networks. The Councils sent separate applications to “MOESK” OJSC for each non-stationary retail facility for technological connection of such facilities; and each application was registered by “MOESK” OJSC under a separate registration number.

“MOESK” OJSC used to combine several applications for technological connection of energy-receiving devices with capacity up to 15 kW from the Councils of districts of Moscow administrative divisions in the subject matter of the same technological connection contract to bundle and increase the maximum capacity of the connected energy-receiving devices –over15 kW. These actions enabled applying the rate for calculating the connecting costs per 1 kW to the electric networks of “MOESK” OJSC at 16,648.80 Rub/kW, instead of 550 Rubles established by the law, which was confirmed by Moscow Department of Trade and Services.

“The unscheduled inspection exposed unlawful actions of the grid company. Based on the inspection findings, FAS forwarded an act to “MOESK” OJSC, although the company objected classification of the circumstances of connecting non-stationary retail facilities by the Councils. FAS initiated a case upon signs of violating the antimonopoly law. Having investigated the case, FAS recognized the violation and issued the necessary determination”, pointed out the Head of FAS Department for Control over Electric Power Industry Vitaly Korolyov.
