OREANDA-NEWS. March 27, 2013. The Federal Arbitration Court of the North-Caucasus District pronounced legitimacy of the determination of Krasnodar Office of the Federal Antimonopoly Service (Krasnodar OFAS Russia) to hold “NESK-Elektroseti” OJSC administratively liable for violating the antimonopoly law and imposing a turnover fine in the size of around one million Rubles.

The Commission of Krasnodar OFAS Russia found that “NESK-Elektroseti” OJSC abused dominance in breach of Article 10 of the Federal Law “On Protection of Competition”. The company violated the law by infringing the interests of a physical person – it refused to execute a contract for technological connection. The Antimonopoly Service issued a determination to eliminate the violation.

“NESK-Elektroseti” OJSC filed a lawsuit, but on 21st March the Federal Arbitration Court of the North-Caucasus District upheld the decision of Krasnodar OFAS Russia.

“The Court judgment confirmed the position of the antimonopoly body that violators, who abused their dominant position, which resulted in infringing the interests of petitioners, shall be held administratively liable in the form of an administrative fine”, commented Deputy Head of Krasnodar OFAS Russia, Irina Ivaschenko.
