OREANDA-NEWS. March 29, 2013. The 2nd Arbitration Appeal Court pronounced legitimacy of the decision of the Office of the Federal Antimonopoly Service in the Komi Republic (Komi OFAS Russia) regarding “Russian Railways” OJSC, which abused its dominant position on the market of freight traffic.

In June 2012, Komi OFAS Russia found that “Russian Railways” OJSC violated Article 10 of the Federal Law “On Protection of Competition” (abusing market dominance). In Usinsk the company charged a consignee for entry to a platform. “Russian Railways” OJSC was issued a determination to stop violating the antimonopoly law.

The monopolist disagreed with the decision of the antimonopoly body and filed a lawsuit. The Courts of two instances, however, dismissed the claim of “Russian Railways” OJSC.

“Our determination came into legal force: “Russian Railways” OJSC must stop charging consignee for entry to a platform. Failure to execute the determination will incur administrative liability”, pointed out Deputy Head of Komi OFAS Russia, Tatiana Mikhailova.
