OREANDA-NEWS. April 10, 2013. Nizhny Novgorod Regional Court pronounced legitimacy of the decision made by the Office of the Federal Antimonopoly Service in Nizhny Novgorod region (Nizhny Novgorod OFAS Russia) regarding “Energoseti” Ltd.

Nizhny Novgorod OFAS Russia received a petition from a homeowners association regarding actions of the energy supplier for putting into service communal heating energy metering device. According to the petitioner, the requirement of “Energoseti” Ltd. to obtain technical conditions for installing communal heating energy metering device was unjustified and infringed the interests of the homeowners association, which for a long period of time had been unable to put into operation heating energy metering device and make payments under its readings.

Having investigated the case, Nizhny Novgorod OFAS Russia found that “Energoseti” Ltd. abused market dominance (Article 10 of the Federal Law “In Protection of Competition”) and fined the company 7.8 million Rubles.

Both the legal entity and a top executive (Director) of the company are held administratively liable. After the court hearing the top executive paid the fine in full.
