OREANDA-NEWS.  April 29, 2013. The Kostroma Regional Arbitration Court pronounced legitimacy of the decision of the Office of the Federal Antimonopoly Service in the Kostroma region (Kostroma OFAS Russia) on the case of “Kostromaoblgaz” OJSC.

The Commission of Kostroma OFAS Russia established that “Kostromaoblgaz” OJSC had charged legal entities for issuing technical conditions for connecting to a gas-distribution network, abusing its market dominance (in breach of Article 10 of the Federal Law “On Protection of Competition”).

Under the Town-Planning Code of the Russian Federation and the Rules for determining and providing technical conditions for connecting capital construction facility to utility networks, technical conditions must be provided free-of-charge.

Thus, “Kostromaoblgaz” OJSC infringed the interests of economic entities that applied for issuing technical conditions. The companies had to incur unreasonable financial costs.
