OREANDA-NEWS. June 14, 2013. The 12th Arbitration Appeal Court organized an inter-regional research-to-practice workshop on the “Pressing Issues of Antimonopoly Enforcement” using video-conferencing.

The Chairman of the 12th Arbitration Appeal Court, Mr. Sharaev, acted as the moderator. Speakers, representing the antimonopoly body, included the Head of FAS Legal Department, Sergey Puzyrevsky; the Head of Judicial Unit of the FAS Legal Department, Ms Ognevskaya; and Deputy Head of Saratov OFAS Russia, Ms. Borisova.

The Head of Controlling-and-Analytical Department, of the Supreme Arbitration Court of the Russian Federation, Ms. Avakyan, also took part in the workshop.

Attendees included the Heads and judges of the Federal Arbitration Court of the Povolzhie District (Kazan), the 11th Arbitration Appeal Court (Samara), the 12th Arbitration Appeal Court (Saratov), Astrakhan Regional Arbitration Court (Astrakhan), Volgograd Regional Arbitration Court (Volgograd), Saratov Regional Arbitration Court (Saratov), and the Arbitration Court of the Republic of Mordovia (Saransk).

Regional Offices of FAS Russia also were able to take part in the workshop through video-conferencing by sending their representatives to arbitration courts.

Participants looked into such issues as abusing market dominance by fixing monopolistically high price (the criteria for using the “costs” methods and the methods of “comparable markets”), violations of the established pricing procedures (in view of the legal opinions of the Presidium of the Supreme Arbitration Court of the Russian Federation), problems of proving oral agreements, anticompetitive actions of public-law entities, violations of antimonopoly law in the course of tenders / auctions (in the part of the powers of the antimonopoly body for investigating complaints with regard to breaching financial insolvency (bankruptcy) procedure, warnings and legal consequences of issuing warnings, administrative liability for violations of the antimonopoly law.

According to the Head of FAS Legal Department, Sergey Puzyrevsky, such events are very important for developing a unified enforcement and judicial practice on antimonopoly regulation.
