OREANDA-NEWS. August 09, 2013. The Office of the Federal Antimonopoly Service in the Nizhniy Novgorod region (Nizhniy Novgorod OFAS Russia) imposed an administrative fine upon “Nizhniy Novgorod International Airport” OJSC – 573,667 Rubles.

On 31st May 2013, Nizhniy Novgorod OFAS Russia found that “Nizhniy Novgorod International Airport” OJSC abused its market dominance (Part 1 Article 10 of the Federal Law “On Protection of Competition”). The airport unlawfully charged a fee for escorting transport within the airport – 5500 Rubles per vehicle.

The Commission concluded that such measures for control transport movements in the airport were part of the internal airport security policy, and, therefore, aviation security in general.

Under the current law, the fee for maintaining aviation security in the airport zone shall be requested only from air carriers and cannot be imposed upon the third parties.

The case was initiated on 2nd April 2013 upon inspection findings. Earlier OFAS received a complaint from an economic entity doing business in the airport about being unlawfully charged for mandatory vehicle escort services within the airport area and for registering passes for entry to the terminal control zone.

Having investigated the case, OFAS issued a determination to “Nizhniy Novgorod International Airport” OJSC to stop violating the antimonopoly law.
