OREANDA-NEWS. September 09, 2013. On 22nd August 2013, the Arbitration Court of St Petersburg and the Leningrad Region pronounced legitimacy of the warning issued by the Office of the Federal Antimonopoly Service in the Leningrad region (Leningrad OFAS Russia) regarding “Lenenergo” OJSC.

A network company - “OEK” OJSC petitioned to Leningrad OFAS Russia reporting that “Lenenergo” OJSC had failed to forward draft contracts for technological connection to the petitioner. Due to absence of signs of avoiding contracts with particular buyers in spite of possibilities of production or supplying relevant goods (a violation of Article 10 of the Federal Law “On Protection of Competition”), the antimonopoly body issued a warning to “Lenenergo” OJSC to stop omissions.

The company disagreed with the warning of Leningrad OFAS Russia and filed a lawsuit; however, the Arbitration Court of St Petersburg and the Leningrad Region dismissed the claim.

“Warning is a relatively new legal instrument of influence upon violators of the antimonopoly law. We are satisfied that it truly works”, emphasized the Head of Leningrad OFAS Russia, Vadim Vladimirov.
