OREANDA-NEWS. September 25, 2013. To increase transparency and efficiency of the mechanisms of developing exchange trade, the Federal Antimonopoly Service (FAS Russia) introduced changes to the Procedures for providing a list of affiliated persons to an exchange by an economic entity that ahs dominant position on a relevant market, accredited and (or) taking part in competitive bidding (particularly, by filing bids through a broker, brokers).

The Procedures are approved by No. 409 FAS Order of 26th June 2012 (further on referred to as the Procedures).

The Procedures required such economic entity to file information about its affiliated persons in the form of a list of affiliated persons compiled according a recommended pattern.

Earlier it did not require specifying the “Personal Tax Reference Number” for the persons affiliated with an economic entity.

At the same time, the practice of using the procedures showed that absence of the filed on the “Personal Tax Reference Number” in the recommended pattern, according to which the list of affiliated persons is submitted to an exchange, makes the work of the exchange with the list of affiliated persons more difficult and makes it more difficult to calculate reserved prices and volumes of sale by economic entities that have dominant position.

No. 567/13 FAS Order of 5th September 2013 adds to the Procedures a field on the “Personal Tax Reference Number” in the data that must be included in the list of affiliated persons to be sent to an exchange by an economic entity.

The Order is submitted to the Ministry of Justice for state registration.
