OREANDA-NEWS. November 12, 2013. Moscow Arbitration Court pronounced legitimacy of the decision of the Federal Antimonopoly Service (FAS Russia) that the Federal Agency for State Property Management (Rosimushcestvo) violated the Federal Law on privatization in organizing an open auction for sales of military immovable property.

The Antimonopoly Service received a complaint from a physical person about actions of Rosimushcestvo, which was the auction organizer. The complaint stated that the auction organizer committed violations with regard to the content of an information notice and placing the notice.

The FAS Commission established that Rosimushcestvo did not place a notice about the auction at the official web-site www.torgi.gov.ru in breach of the procedures specified in the Federal Law “On Privatization of State and Municipal Property”, which could have resulted in restricting competition.

The Antimonopoly Service issued a determination to the auction organizer. The Federal Agency for State Property Management disagreed with the determination and filed a lawsuit. The Court of First Instance, however, dismissed the claim.
