OREANDA-NEWS. December 24, 2013. The Federal Antimonopoly Service (FAS Russia) found that Prefecture of North-Eastern Administrative District of Moscow, “PUBLICITY BUILDING No.2 Project” Ltd. and “Publicity” RBOF violated Article 16 of the Federal Law “On Protection of Competition”, аnd “PUBLICITY BUILDING No.2 Project” Ltd. and “Delta Stroi” Ltd. violated Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition” in the auctions for capital repair works of 48 backyard sport fields in North-Eastern Administrative District of Moscow in 2011.

The FAS Commission established that the Prefecture of North-Eastern Administrative District of Moscow jointly with “Publicity” RBOF drafted the auction documentation in such a way that potential auction bidders could not file competitive bids and all bidders, except the two bidders determined in advance, were not allowed to bid at the auction.

In its turn, “PUBLICITY BUILDING No.2 Project” Ltd. colluded with “Delta Stroi” Ltd. to maintain auction prices at the maximum level.

As a result of those unlawful actions “PUBLICITY BUILDING No.2 Project” Ltd. won in an open auctions with the minimum price reduction (1% of the contract price). The contract price is over 100 million RUB.

Initiating an antimonopoly case is a result of cooperation between FAS and the law enforcement bodies. The Investigative Department in North-Eastern Administrative District of Moscow with regard to officials of North-Eastern Administrative District of Moscow and “PUBLICITY BUILDING No.2 Project” Ltd. are already investigating a criminal case initiated upon signs of abusing abuse of office and fraud.

“Social obligations are a priority area of the state policy. The means obtained as a result of savings in state procurement enabled the state to exercise more socially important functions. In the near future FAS will hold legal entities administratively liable, and the case materials will be forwarded to the law enforcement bodies to initiate a criminal case under Article 178 of the Criminal Code”, pointed out the Head of FAS Alexander Kinev.
