OREANDA-NEWS. January 13, 2014. Moscow Arbitration Court confirmed legitimacy of 500,000 RUB fine imposed by the Office of the Federal Antimonopoly Service in the Republic of Dagestan (Dagestan OFAS Russia) upon “RusLine” Airlines” CJSC for failure to submit information to the antimonopoly authority.

The antimonopoly body requested information from the air carrier required to execute the instructions given by the Federal Antimonopoly Service (FAS Russia). However, “RusLine” Airlines” CJSC failed to submit information to Dagestan OFAS Russia within the designated period and did not petition to OFAS to extend the period of submitting such information. The antimonopoly body drew up a Protocol on committing an administrative violation by the air carrier. Only then the requested data were submitted to OFAS.

The fine was imposed upon “RusLine” Airlines” CJSC on the basis o considering the protocol.

The air carrier disagreed with the fine and filed a lawsuit to Moscow Arbitration Court, which, however, dismissed the claim.

The Head of Dagestan OFAS Russia, Kurban Kubasaev, commented on the situation: “Under Part 5 Article 19.8 of the Code of the Russian Federation on Administrative Violations, failure to submit data to the federal antimonopoly authority, its regional bodies in due time is punishable by a fine upon legal entities from 300,000 RUB to 500,000 RUB. The air carrier is fined 500,000 RUB since “RusLine” Airlines” CJSC was already fined 300,000 RUB for a similar violation”.
