OREANDA-NEWS. March 14, 2014. Majilis approved in first reading the bill "On amendments to some legislative acts of Kazakhstan on strengthening property rights protection, ensure the protection of treaty commitments and toughening responsibility for their violation".

"It is provided for Article 922 of the Civil Code to be submitted reference rule to clarify Article 267, on the State's responsibility for the violation of the rights of owners as a result of the publication of illegal acts by public organs or officials, regardless of their guilt," the Minister of Justice Berik Imashev said presenting the bill.

In addition, according to the Minister, this amendment eliminates ambiguous rules on early performance of obligations secured by a pledge of claim to mortgaged property.

The bill also makes provision for information on a specific object of real estate must be issued at the request of other persons with the consent of the rightholder, and determines a comprehensive range of persons entitled to obtain access to such information without the consent of the rightholder.   A mandatory electronic state registration of rights to real estate in case of conclusion of notarially authenticated transaction has also been established.
