OREANDA-NEWS. April 15, 2014. SORAINEN represented Barclays Technology Centre Lithuania Branch in litigation with a former employee over a performance termination case.

The courts of first and appellate instance rejected all claims by the former employee. In particular, they recognised that the employer had a legitimate ground for individual termination without the employee’s fault based on company performance management policy. The courts also recognised the employer’s discretionary right to assess individual employee performance.

This case represents a further shift of local courts to the flex-security principle in judging individual termination without employee’s fault and to the internal performance management systems of international companies. SORAINEN provided full legal support to Barclays starting with early pre-court stage of the case and ending with appellate proceedings.
