OREANDA-NEWS. June 03, 2014. FAS received information that the Ministry of the Irkutsk Region on Health Care had passed No. 496-pr Order “On Providing Haemodialysis Assistance” of 20.03.2014 prohibiting the Regional Commission for Selecting Patients to issue referrals for out-patient haemodialysis to “Clinical Medicine Research Institute” International Health Institution Care in Irkutsk from 21st March 2014.

In the course of the investigation upon elements of the Ministry of the Irkutsk Region on Health Care violating Part 1 Article 15 of the Federal Law “On Protection of Competition”, FAS sent an enquiry to the regional office of Roszdravnadzor [the Federal Service on Surveillance in Health Care] in the Irkutsk region to clarify the position on legitimacy of the actions undertaken by the Ministry of the Irkutsk Region on Health Care.

According to the information available to FAS, the regional office of Roszdravnadzor in the Irkutsk region warned the Ministry of the Irkutsk Region on Health Care to undertake measures to eliminate infringements of citizens’ rights in health care and adjust No. 496-pr Order in accordance with the law of the Russian Federation.

No. 721-mr Order of the Ministry of the Irkutsk Region on Health Care of10.04.2014 abolished No. 496-pr Order. Thus, elements of violating the antimonopoly law were eliminated before initiating a case.

“The position of the regional office of Roszdravnadzor in the Irkutsk region should be highly commended because thanks to its prompt actions not only citizens’ rights for haemodialysis medical assistance were restored, but elements of violating the antimonopoly law were eliminated within the shortest possible time, that could have resulted in restricting competition between medical organizations in the Irkutsk region”, pointed out the Head of FAS Department for Control over Social Sphere and Trade, Timophei Nizhegorodtsev.
