OREANDA-NEWS.  June 27, 2014. Moscow Arbitration Court pronounced legitimacy and reasonableness of the decision of the Federal Antimonopoly Service (FAS Russia) on the case against “Baltiisky Works – Shipbuilding” Ltd. (“BZS” Ltd.)

On 16th January 2014, FAS found that “BZS” Ltd. violated the procedures for determining the winner of a request for proposals for the right to conclude a contract for supplying high-strength ship rolled metal products for building LK-60 head universal nuclear ice-breaker (a request for proposals).

FAS established that evaluating and ranking bids, “BZS” Ltd. used an additional evaluation criteria not provided for in the procurement documentation. Thus, bids evaluation did not comply with the procedures determined by “BZS” Ltd. in the company’s procurement documentation.

“BZS” Ltd. disagreed with the FAS decision and filed a lawsuit to invalidate and abolish it.

Moscow Arbitration Court dismissed the claim and, therefore, confirmed legitimacy of the actions undertaken by the antimonopoly authority.
