OREANDA-NEWS. December 19, 2008. The Moscow Government presented the documents to the Federal Antimonopoly Service (FAS Russia) confirming that the Moscow Government fulfilled the FAS Russia's determination on the case of floating landing stages, reported the press-centre of FAS Russia.

On 25th April 2008, FAS Russia recognized that the Moscow Government violated Part 1 Article 15 of the Federal Law "On Protection of Competition" by creating obstacles to economic activity of the market entities that use floating landing stages and other waterborne devices, as well as Article 16 of the Federal Law "On Protection of Competition" by engaging in concerted actions with the Moscow City Department of the State Road Traffic Safety Inspectorate, of the Central Internal Affairs Directorate, the "Gormost" State Unitary Enterprise, the "Mosvodokanal" Moscow State Unitary Enterprise and "Moskovskaya Gorodskaya Electrosetevaya Kompania [Moscow City Electric Grid Company]" OJSC, unreasonably preventing economic activities of the market entities that use floating landing stages.

Based in its decision, FAS Russia issued a determination to stop the antimonopoly violation to the Moscow Government, the "Gormost" State Unitary Enterprise, the "Mosvodokanal" Moscow State Unitary Enterprise, the Moscow City Department of the State Road Traffic Safety Inspectorate, of the Central Internal Affairs Directorate and "Moskovskaya Gorodskaya Electrosetevaya Kompania" OJSC.

The Moscow Government disagreed with the decision and determination of FAS Russia and appealed them in the part related to the Moscow Government.

The Moscow Arbitration Court dismissed the claim of the Moscow Government; the Court of the Appeal Instance upheld the ruling of the Court of First Instance, therefore, confirming legitimacy and relevance of the FAS Russia's decision and determination regarding the Moscow Government.

Taking into consideration mentioned above, the Moscow Government fulfilled the FAS Russia's determination by canceling its instructions on the Minutes of meetings of officials of the Moscow Governmentу as well as the Minutes of the meeting of the Moscow Government Commission on Regulating the Use of the Water Area and Waterside Areas in Moscow, regarding the location and operation of the floating landing stages. The relevant documentation was presented.
