OREANDA-NEWS. On 22nd March 2007, the Moscow Arbitration Court confirmed validity of decision and determinations of the Federal Antimonopoly Service (FAS Russia) on the case against "Caustic", reported the press-centre of  FAS Russia. Previously FAS Russia found that "Caustic" had breached Article 10 of the Federal Law "On Competition Protection" (which prohibits abusing dominant position).  The case was initiated on petition of "Khimprom" OJSC that "Caustic" had set monopolistically high price on the underground brine (sodium chloride brine) and refused to supply this product.


Having considered the case, FAS Russia ordered "Caustic" to stop abusing its dominant position and undertake actions to ensure competition protection. In particular: "Caustic" was instructed that until the above agreement was singed, it should supply underground brine to "Khimprom" in the amount required to ensure production operations of "Khimprom", at the existing market prices with further recalculation based on economically justified price according to the indicated sub-points.  "Caustic" disagreed with the determination issued by the antimonopoly authority and appealed.  The Moscow Arbitration Court passed a ruling that confirmed validity of the decision and determinations issued by the FAS Russia Commission to "Caustic".
