OREANDA-NEWS. April 11, 2008. Dniproenergo had been a bankrupt since 2001. In December, 2006 the committee of creditors openly invited all interested investors to take part in rehabilitation of the enterprise. SCM Group suggested its rehabilitation plan for Dniproenergo by offering to provide UAH 1 bn to repay debts to the creditors and another UAH 1 bn to modernize the enterprise, reported the press-centre of SCM.

This plan was approved by both creditors and the state. In September-October 2007, Dniproenergo received the funds and repaid its debts to the creditors and the state as being the major among them. Today the company is in good health, confident in its future, and has ambitious plans.
 
SCM Group observes the rule of law in its activity and is certain that each step DTEK has taken in the process of Dniproenergo rehabilitation was legal. Also, proceeding from this principle, we believe that all discrepancies must be settled only in court.

The court made a decision on 8 April, 2008, the operative part of which we know. Now we are considering two possible variants of our actions: either to challenge the court decision or accept it, provided the state as the major creditor returns the invested funds to us. The choice of SCM Group will largely depend on the explanatory part of the Supreme Court decision, which we expect will be developed and announced soon.
 
Once the decision about our further steps is made, we will make it public.
