OREANDA-NEWS. October 24, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the Pension Fund of the Russian Federation violated the law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violations, reported the press-centre of FAS Russia.

The case was initiated upon a petition of "Aquarius" Production Company" Ltd.

The Pension Fund of the Russian Federation did not accept the company's bid for competing in the auction for supplies of servers. The Pension Fund justified its refusal that the bid was in contradiction with the technical specifications for the auction, and the controlling means offered by "Aquarius" were not produced by the company and required installation of additional equipment and paid software, nonintegrated in the distribution kit.

Having investigated the circumstances of the case, FAS Russia concluded that the Pension Fund of the Russian Federation groundlessly rejected the company's bid for participating in the auction and violated the pre-qualification procedures and the procedures for bids consideration. Also the Pension Fund of the Russian Federation set the requirement that the bid should have included the documents or copies of the documents that were to be transferred with the order, which contravened the Law "On State Procurement".

FAS Russia issued a determination to the Pension Fund requesting it to eliminate the violations. Violations of the Law "On State Procurement" are punishable under the Code of the Russian Federation on Administrative Violations.
