OREANDA-NEWS  On 06 March was announced, that the Federal Antimonopoly Service (FAS Russia) fined "RZhD" OJSC 300 000 Rubles under Part 5 Article 19.8 of the Code of the Russian Federation on Administrative Violations for knowingly submitting incorrect information to the antimonopoly authority.

FAS Russia received a petition of "SeverStal" OJSC. The Petitioner reported that "RZhD" OJSC had regularly introduced limitations and banned loading certain types of goods or all goods at Cherepovets 2 station, the town of Koshta, which belongs to the Severnay Railway - a branch of "RZhD" OJSC, as well as introduced limitations and banned loading goods destination to other stations.

Having processed the petition, and based on the submitted materials, FAS Russia initiated a case against "RZhD" OJSC for violating Part 1 Article 10 of the Federal Law "On Protection of Competition" (which prohibits abusing dominant position).

Investigating the case, FAS Russia established that with its petition "SeverStal" OJSC submitted to FAS Russia copies of the telegrams from "RZhD" OJSC on introducing the bans and restriction for loading (transportation) of goods by railway transport for "SeverStal" OJSC as well as on canceling conventional bans for loading (transportation) of goods related to "SeverStal" OJSC.

"RZhD" OJSC submitted incorrect information to FAS Russia regarding one of the telegrams.

Under Article 25 of the Federal Law "On Protection of Competition", commercial and non-commercial organizations, federal executive bodies, authorities of the constituent territories of the Russian Federation, local self-government bodies, other agencies exercising the functions of the above bodies or organizations, as well as state extra-budgetary funds, and physical persons, including individual entrepreneurs, must submit to the antimonopoly authority, upon its reasonable request documents, written or oral explanations, information (including commercial, insider, or other information protected by law), which are required by the antimonopoly authority in accordance with its powers to process petitions and materials on antimonopoly violations, to control economic concentration or to determine the state of competition.
